Terms of Service

1. INTRODUCTION
Welcome to Bloom. These Terms of Service ("Terms") govern your use of the Bloom mobile application, website, and related services (collectively, the "Service") provided by Bloom Up OÜ. By accessing or using the Service, you agree to be bound by these Terms.
2. THE SERVICE
Bloom is a marketplace platform that connects:
- "Artists": Users seeking to book recording studios and related services.
- "Hosts": Users (Studio Owners) offering recording studio spaces, equipment, and services.
Important: Bloom acts solely as an intermediary. We are not a party to any rental agreement or service contract entered into between Artists and Hosts. We do not own, control, or manage the studios listed.
3. ACCOUNTS AND REGISTRATION
- Eligibility: You must be at least 18 years old to create an account.
- Account Types: Users may register as Artists or Hosts.
- Verification: We may require identity verification (via third-party providers) to maintain platform safety.
- Security: You are responsible for safeguarding your login credentials. You accept responsibility for all activities that occur under your account.
4. BOOKING AND PAYMENTS
4.1. Booking Process
- Bookings are made directly through the Service.
- A booking is considered "Confirmed" only when the payment transaction is successfully processed.
4.2. Pricing and Fees
- Host Fees: Hosts set their own hourly rates and service pack prices.
- Service Fees: Bloom charges a service fee (commission) on each transaction to cover platform maintenance and payment processing costs.
- Taxes: Users are responsible for determining and paying any applicable taxes (VAT, etc.).
4.3. Payments via Stripe
- All payments are processed securely through Stripe.
- Split Payments: For "Share Booking" sessions, each participant pays their share directly via Stripe.
- Payouts: Hosts must connect a valid Stripe Connect account to receive payouts. Funds are transferred to the Host's account according to Stripe's payout schedule, minus applicable fees.
5. "SHARE BOOKING" FEATURE
Bloom offers a unique "Share Booking" functionality that allows users to split the cost of a studio session.
- Organizer Liability: The user initiating the Share Booking acts as the Organizer.
- Join Requests: Invited users ("Participants") must accept the invitation and complete their payment share to join.
- Confirmation: A Share Booking may remain in a "Pending" state until the required number of participants have paid or the Organizer covers the remaining balance.
- Chat: A group chat is automatically created for the booking only after valid participation is confirmed.
6. CANCELLATIONS AND REFUNDS
- Host Policy: Cancellation policies are determined by the Host and displayed on the Studio listing.
- Disputes: Any dispute regarding the quality of the studio or service must be resolved directly between the Artist and the Host. Bloom may act as a mediator but has no obligation to refund payments on behalf of the Host.
7. USER CONDUCT AND RESTRICTIONS
You agree NOT to:
- Use the Service to negotiate bookings with the intent of completing the transaction outside of Bloom (fee avoidance).
- Harass, bully, or intimidate other users. We have a zero-tolerance policy and provide blocking/reporting tools.
- Upload false, misleading, or illegal content (including Studio images or Profile pictures).
- Misuse the "Friend" system to spam other users.
8. CONTENT AND INTELLECTUAL PROPERTY
- User Content: By uploading photos (e.g., Studio Images, Avatars), you grant Bloom Up OÜ a non-exclusive, worldwide license to display this content for the purpose of operating and promoting the Service.
- Platform IP: The Bloom logo, design, code, and "look and feel" are the property of Bloom Up OÜ and may not be copied without permission.
9. LIABILITY AND DISCLAIMER
- "As Is" Service: Bloom is provided "as is" without warranties of any kind.
- Venue Liability: Bloom is not responsible for any damage to studio equipment caused by Artists, nor for any personal injury or loss occurring at a Host's facility. Hosts are encouraged to obtain appropriate insurance.
- Limitation: To the maximum extent permitted by law, Bloom's liability shall be limited to the amount of service fees paid by you to Bloom in the 12 months prior to the claim.
10. TERMINATION
We reserve the right to suspend or delete your account if you violate these Terms, specifically for:
- Repeated cancellations.
- Harassment of other users.
- Fraudulent payment activity.
- Attempting to bypass the platform's payment system.
11. GOVERNING LAW
These Terms are governed by the laws of Spain. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Spain.
